Liberty Counsel sues against Government Takeover of Healthcare

It's only begun.

Prior to midnight yesterday, Liberty Counsel filed a federal lawsuit against the newly signed healthcare law on behalf of Liberty University. The suit names as defendants the U.S. Secretary of the Treasury, Timothy Geithner, the Secretary of the U.S. Department of Health and Human Services, Kathleen Sebelius, the Secretary of Labor, Hilda Solis, and the U.S. Attorney General, Eric Holder, in their official capacities overseeing the enormous government expansion in health care regulations.

Forcing health insurance on every person and employer is a stunning example of arbitrary power the Constitution does not give to federal bureaucrats.

Health Care Bill Passes 219 - 212, Off to Obama's Desk

From the desk of Phyllis Schlafly, Eagle Forum:

Washington, D.C. - Phyllis Schlafly, president and founder of the conservative grassroots public policy organization Eagle Forum, made the following remarks after the public announcement that formerly pro-life Democrat Bart Stupak (D-MI) will cast a "yes" vote for the Senate health care bill today in the House.
UPDATE: Just before 11pm Eastern, the U.S. House of Representatives passed the Patient Protection and Affordable Care Act (H.R. 3590) by a vote of 219 to 212 (Roll Call 165).

"It is naïve for any elected official, especially one who describes himself as ‘pro-life,' to expect that a promise to issue an Executive Order that reasserts the intentions of the Hyde Amendment will be fulfilled by the most pro-abortion president to ever sit in the White House. Perhaps Mr. Stupak and his fellow pro-life Democrats forget that President Obama's first Executive Order was the repeal of the Mexico City Policy to allow for international funding of abortion."

"Not only would an Executive Order be rendered meaningless in the face of Congress passing legislation which actively provides for the massive expansion and funding of abortion services, but anyone who doubts the abortion tsunami which awaits this bill becoming law lives in a fantasy world."

"Barack Obama has lined every existing federal agency with the most dedicated pro-abortion ideologues, and we know that he will continue this pattern of pro-abortion appointments when it comes time for him to fill the over-100 bureaucracies created to administer his socialized health care program."

"Any formerly pro-life Democrat who voted ‘Yes' on the Senate health care bill tonight will be forever remembered as being among the deciding votes which facilitated the largest expansion of abortion services since Roe v. Wade."

"Mr. Stupak and his Democrat followers have now clarified that you cannot be pro-life and be a Democrat. If abortion was truly their biggest issue, they wouldn't willfully align themselves with the Party of Death."

"This vote has exposed the myth of the ‘pro-life Democrat.' With this single vote, the Democratic Party has divided our nation into the Democrat Party of Death and the Republican Party of Life, and future elections will never be the same."

RICHFIELD CANDIDATES SHARE CONCERNS AT EAGLE FORUM EVENT

March 17, 2010

Richfield:
Area candidates shared their vision of local government at a forum at the Richfield Elementary School last night. Three candidates for the Richfield village board and the Richfield Joint School Board talked to residents at the forum sponsored by Eagle Forum of Wisconsin. All candidates for were invited, and candidates unable to attend were offered the opportunity to provide literature for attendees. State Rep. Don Pridemore (R-Hartford) moderated the event.

Michael Shea, village board candidate, brought a copy of the $3 million village budget and discussed the need to prioritize expenditures. Budget approval would need to be "examined under a microscope." Shea stated he was running because he "didn't like what's going on in the village." Responding to a question regarding upholding integrity on the village board, Shea said one should "live on your morals and whether your word is any good." His motto is "tell the truth or get out." As for TIF districts, Shea adamantly proclaimed, "forget it" and "It's a big fat failure at the expense of taxpayers."

Unemployment was addressed and Shea felt that re-examining municipal contracts to "see what is being done inefficiently" was the key. His goal as village trustee would be to outsource services to local companies. A former police officer of 29.5 years, Shea feels that [we] "under-utilize people in our jails."

A controversial issue within the village of Richfield is the movement of the public comment period to the end of village board meetings. Shea stated his opposition to this decision by the village board and felt that "the public that pays the salaries of these people should be the first ones up" at the meetings.

As to why he would be the best candidate for the trustee position, Shea regarded the fact that he was the only trustee candidate to clear his calendar for tonight's forum. "You have to demonstrate to people that you're willing to tackle the problems."

Howard Wolf and Blair Rogacki, both Richfield school board candidates, agreed on a number of hot-topic issues, such as parental consent prior to Comprehensive Sex Education classes and keeping social justice curriculum out of primary education. Wolf said schools should be "molding young minds with facts, not indoctrinating with those who are opining."

School funding has raised concerns among taxpayers who are already strapped during tough economic times. Wolf explained "We only tax for what we need." Both candidates, again, cited the lack of financial assistance from the government. Rogacki, labeling himself a fiscal conservative, stated the formula was basically "you have a pot of money available to spend and services that need to be provided. You prioritize and do what you can." Wolf would like to "mentor new board members" during his tenure so that all his work "won't be for naught."

"This was a great opportunity to give taxpayers the chance to hear directly from the candidates," stated Ginny Maziarka, Eagle Forum of Wisconsin, Washington County president. "We were thrilled to have Rep. Pridemore attend as our moderator. There is a real need for one-on-one time with candidates before the general election, to share with voters why they should belong in office."

PUBLIC SCHOOLS collecting far more personal info than needed

Phyllis Schlafly reports:
Far more personal information on students than is necessary is being collected by public schools, according to the Fordham Law School Center on Law and Information Policy, which investigated education records in all 50 states. States are failing to safeguard students' privacy and protect them from data misuse.

Some states collect a lot of data that has nothing to do with student test scores, including Social Security numbers, disciplinary records, family wealth indicators, student pregnancies, student mental health, illness, and jail sentences. A couple of states record the date of a student's last medical exam and a student's weight.

The Fordham study reported that this collection of information is often not compliant with a 35-year-old law, the Family Educational Rights and Privacy Act (FERPA). The only punishment for a FERPA violation is for the Department of Education to withhold federal education funding, but the Department has never done that.

The building of databases that track students from pre-school through entry into the workforce began with the emphasis in the 1990s on testing and standards, and was expanded under "No Child Left Behind" mandates. This data collection has been proceeding at what observers call a "breakneck pace" under the Obama Administration because of the offer of federal grants awarded through the Race to the Top competition, the American Recovery and Reinvestment Act, and $250 million in Stimulus funds.

Fordham law professor Joel R. Reidenberg, who oversaw the Fordham study, said that states are "trampling the privacy interests of those students." He warns that years later, when these kids are adults, information from their elementary, middle and high school years can easily be misused by hackers and others.
